THISTLE AI^ is a automated trading bot for Futures/CFDs.
THE FUNGIBLES^ is collection of digital artworks (NFTs) created by A.I. and code experiments, that runs on the Ethereum network. These NFTs give you access to the THISTLE AI^ trading bot which automates cryptocurrency trades to attempt to generate profits with a hands-off approach. This website is only an interface allowing participants to exchange digital collectibles and use its underpinned trade execution technologies. Users are entirely responsible for the safety and management of their own private Ethereum wallets and validating all transactions and contracts generated by this website before approval. Furthermore, as the THE FUNGIBLES^ smart contract runs on the blockchain, there is no ability to undo, reverse, or restore any transactions of purchase.
$THISTLE is the native currency of the THISTLE^ brand. While the THE FUNGIBLES^ is a non-fungible token (NFT) collection that comprises thousands of evolving images of all active cryptocurrency prices across the previous 30 days, $THISTLE is a fungible ERC-20 token with a maximum supply and is tradable on Decentralised and Centralised Exchanges.

This website and its connected services are provided “as is” and “as available” without warranty of any kind. By using this website you are accepting sole responsibility for any and all transactions or trades involving THE FUNGIBLES^ digital collectibles, THISTLE AI^ trading Bot, THISTLE ORACLE^ indicator and $THISTLE cryptocurrency.

i. You Own the NFT and any $THISTLE tokens you may hold. Each art piece is an NFT on the Ethereum blockchain. When you purchase an NFT, you own the underlying Art, completely. Ownership of the NFT is mediated entirely by the Smart Contract and the Ethereum Network: at no point may we seize, freeze, or otherwise modify the ownership of any collectible.

ii. Personal Use. Subject to your continued compliance with these Terms, Thistle Capital grants you a worldwide, royalty-free license to use, copy, and display the purchased Art, along with any extensions that you choose to create or use, solely for the following purposes: (i) for your own personal, non-commercial use; (ii) as part of a marketplace that permits the purchase and sale of your Collectible / NFT, provided that the marketplace cryptographically verifies each Collectible owner’s rights to display the Art for their Collectible to ensure that only the actual owner can display the Art; or (iii) as part of a third party website or application that permits the inclusion, involvement, or participation of your Collectible, provided that the website/application cryptographically verifies each Collectible owner’s rights to display the Art for their Collectible to ensure that only the actual owner can display the Art, and provided that the Art is no longer visible once the owner of the Collectible leaves the website/application.

iii. Commercial Use. Subject to your continued compliance with these Terms, Thistle Capital grants you an unlimited, worldwide license to use, copy, and display the purchased Art for the purpose of creating derivative works based upon the Art (“Commercial Use”). Examples of such Commercial Use would e.g. be the use of the Art to produce and sell merchandise products (T-Shirts etc.) displaying copies of the Art. For the sake of clarity, nothing in this Section will be deemed to restrict you from (i) owning or operating a marketplace that permits the use and sale of Collectibles generally, provided that the marketplace cryptographically verifies each Collectible owner’s rights to display the Art for their art to ensure that only the actual owner can display the Art; (ii) owning or operating a third party website or application that permits the inclusion, involvement, or participation of Collectible generally, provided that the third party website or application cryptographically verifies each Collectible owner’s rights to display the Art for their Collectible to ensure that only the actual owner can display the Art, and provided that the Art is no longer visible once the owner of the Purchased Collectibles leaves the website/application; or (iii) earning revenue from any of the foregoing.

ORACLE^ is a Trading indicator and a tool only for information purposes. A regulatory license is not required, and you are required to have an authorised account to access the script.

THE FUNGIBLES^ NFT are non-fungible tokens with no value except acting as a key to access out platform and use our services like the THISTLE AI^ bot. This is not a regulated activity.

THISTLE AI^ is an automated trading bot that simply executes trades on any account that is connected to our platform.
- Access is granted only for the Crypto bot and this is not a regulated activity requiring a license.
- You will not be granted access to the Securities bot unless you live in a jurisdiction that does not require licensing for software like ours to execute trades on your own account or if you live in a country that does not regulate securities trading.

$THISTLE is our native cryptocurrency token however it is not designed to be a security or a capital market product:
- A holder of $THISTLE has NO rights to Access and use this platform;
- A holder of $THISTLE has No rights to the company or the brand in any form in present or in the future;
- The brand has no right to buy back the $THISTLE tokens from holders and neither does it offer to do so in the future;
- The $THISTLE token does not offer any royalties or commissions to its holders;
- The $THISTLE token will not provide its holder any other rights or functions attached to it.
- The $THISTLE token cannot be used to exchange for other goods or services.
- Holding the $THISTLE token is merely support for the brand to continue its development works and realise new innovative technologies to deliver its mission plan.
- You can sell your $THISTLE token to other users at any time on any listed official brokers or exchanges online at the current market prices.
- The $THISTLE token does not constitute as a capital markets products under the Singapore Financial Authority's legislations.
- The $THISTLE token and its owner are not subject to any requirement under the SFA or the FAA in Singapore. However, all THISTLE products abide by other Singapore laws, including the CDSA, the TSOFA and the UN Regulations, in the conduct of its business.
- The $THISTLE token is not considered a digital payment token under the Payment Services Act in Singapore as it is not or is not intended to be, a medium of exchange accepted by the public, or a section of the public, as payment for goods or services or for the discharge of a debt.

All first time purchases are made on our website by minting using buttons like Buy with Metamask or Buy with CARD . Secondary purchases are on Opensea, Rarible and similar marketplaces. Transactions are recorded on the blockchain and payments can be made in various compatible/bridged crypto currencies.

Non Fungile Tokens bought by card will be air dropped to your wallet address provided.

As creators of all our NFT art work, we retain a royalty depending on the collection for every subsequent sale on secondary markets. With these parameters set on the blockchain metadata.

The Fungibles^ NFT contract takes a set 10% Royalties from all secondary sales in perpetuity.

We only earn royalties on our NFTs. Not our tokens.

Subscription to the Trading indicator ORACLE^ is by an automatically recurring payments subscription service. The prices are found on the respective pages.

Access to the Trading bot THISTLE AI^ is by ownership of The Fungibles^ NFT (Non Fungible Token). The prices for the NFT are found on the respective pages.
Access is granted only for the Crypto bot. You will not be granted access to the Securities bot unless you live in a jurisdiction that does not require licensing for software like ours to execute trades on your own account or if you live in a country that does not regulate securities trading.

Once you purchase a THE FUNGIBLES^ NFT, within the hour, you will be able to open an account with the trading bots in order to set up your account.

We work anonymously due to the fact that our proprietary technology which inherently does good by bringing financial emancipation to our subscribers, also brings a plethora of hackers and scammers attempting to breach our defences. - All sensitive user information is encrypted both in transit and at rest. Thistle Capital uses AWS, who has a proven track record for physical security and internal controls. More information can be found here.
- User passwords are stored encrypted as per industry standards.
- Your own account log ins are only possible through blockchain signed access using services like "Metamask" therefore giving you complete protection as long as you keep your blockchain waller "seed phrases" secure. If you believe it has been compromised, contact us for help on how to migrate to a new wallet for login.
- Exchange API keys are stored encrypted as per industry standards and only decrypted when syncing account information or when the user performs actions against their linked accounts.
- Thistle Capital uses world-class standards to shield user data from unauthorized intrusion. It is always protected with multiple layers of encryption (256-bit encryption over the network). All website data is transmitted over encrypted Transport Layer Security (“TLS”) connections (i.e., HTTPS).
- Thistle Capital leverages the content-security policy (“CSP”) and HTTP Strict Transport Security (“HSTS”) features in modern browsers.
- We use Rackspace Web Services to mitigate potential distributed denial-of-service (“DDoS”) attacks and use AWS WAF to mitigate any attacks on applications for defense in depth.
- Rate limits and ReCaptcha are in place to thwart brute-force and automated scripting attacks.
- Admin panels are not exposed to the public and only a few authorized managers have access to it.
- If we automate your account creation when you connect to our site by using our NFTs or you reply to a marketing offer sent for example about ORACLE^, we will delete your account within 3 days if you do not complete your subscription.
- Thistle Capital conducts regular pen-testing of applications and infrastructure as per OWASP top 10 standard and compliance to these standards is tested before each and every code deployment to ensure production code is vulnerability free.
-Further, we ask users not to reuse their Thistle Capital password on other sites and generate exchange API keys with limited permissions granting our systems only the access required by the user.
- User account access is only possible using Blockchain wallets that sign transactions to verify the ownership of account before allowing login.

Thistle Capital adheres to high standards of integrity in the conduct of its business and ensures that its behaviour and the manner in which it chooses its project sponsors, clients, co-financiers and counterparties meets these standards. These standards include identifying and countering money laundering (ML) and terrorism financing (TF) risks.
- As a non-deposit taking institution established by international treaty, Thistle Capital is not formally subject to national or supranational regulatory supervision, or anti-money laundering and counter financing of terrorism (AML/CFT) legislation.
- Nevertheless, Thistle Capital has an anti-money laundering programme to facilitate compliance with AML/CFT good practices which includes internal procedures and integrity guidelines on how to identify, assess and respond to money laundering and terrorist financing risks in cryptocurrency projects.
- Thistle Capital’s AML/CFT programme includes, but is not limited to, the following activities:
i) Identification of potential ML/TF risks relevant to each user;
ii) Screening clients and key counterparties against relevant sanctioned countries by IP address;
iii) Identification of beneficial owners email address relevant to each NFT that is connected to the site;
iv) Regular monitoring for integrity and reputational risks that may arise during the life of a project, including ML and TF financing risks;
v) Due diligence for all clients and sectors where any financial payment is made through licensed third party platforms like STRIPE;
vi) Enhanced procedures for assessing risks associated with politically exposed persons by name searches on user accounts;
vii) Thistle Capital will not provide financing or award any contract or account for the supply of goods, works or services to any person or entity that, according to the UN Security Council and/or the counter-terrorism subsidiary bodies of the Security Council, is or may be supporting terrorism;
viii)We regularly monitor and improve our audit practices and technologies to identify such abuse of systems and laws;
ix) Thistle Capital is committed to participating in international efforts to counter money laundering and terrorism financing as we operate in a cryptocurrency and blockchain sector that is associated in general with higher risk of money laundering.

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules. Your arbitration fees and your share of arbitrator compensation shall be governed by Consumer Rules and, where appropriate, limited by Consumer Rules. The arbitration may be conducted in person, through the submission of documents, by phone, or online. If for any reason, a Dispute proceeds in court rather than arbitration, the Dispute shall be commenced or prosecuted in the state and federal courts located in New York County, New York, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction, and forum non conveniens with respect to venue and jurisdiction in such state and federal courts. Application of the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) are excluded from these Terms of Use.

In no event shall any Dispute brought by either Party related in any way to the Site be commenced more than one (1) year after the cause of action arose. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.

The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

Exceptions to Arbitration
The Parties agree that the following Disputes are not subject to the above provisions concerning binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.

If you wish to terminate your account, you may do so at any time by selling your NFT. You will be responsible for making your trading bot inactive.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

You agree to indemnify, defend and hold harmless Thistle Capital International., its principals, officers, directors, representatives, employees, contractors, licensors, licensees, suppliers and agents, from and against any claims, losses, damages, losses, obligations, costs, actions or demands.

These include but are not limited to: (a) legal and accounting fees resulting from your use of the Service; (b) your breach of any of these Terms; (c) anything you post on or upload to the Service; and (d) any activity related to your account. This includes any negligent or illegal conduct by you, any person or entity accessing the Service using your account whether such access is obtained via fraudulent or illegal means.

Limitation of liability

In no event shall Thistle Capital, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Governing Law
